Terms of use and sale
These terms govern the use of Loopea, a habit tracking application published by Eloan Da Silva Gentet EI. Creating an account means you accept them.
1. Purpose of the service
Loopea lets you set up habits, check them off day after day, and view their regularity as streaks, consistency percentages and a shareable recap card. The service is provided as is, and is accessible from a web browser.
Loopea is a personal tracking tool. It is not a medical device, a health service or a therapeutic program, and it never replaces the advice of a health professional.
2. Account
- Signing up is free and requires a valid email address.
- You are responsible for keeping your credentials confidential.
- An account is personal and cannot be shared.
- You can delete your account at any time from the settings, without giving a reason.
3. Prohibited uses
In particular, it is forbidden to try to access another user's data, to disrupt the operation of the service, to use it for unlawful purposes, or to automate a volume of requests likely to degrade its availability. An account in breach may be suspended or deleted, after a warning unless the situation is urgent or clearly serious.
4. Free plan and Premium plan
Loopea can be used for free, with no credit card and no time limit: creating habits, daily tracking, statistics and the recap card are included in the free version. Quantified habits (with a numeric target, such as "3 glasses of water") are limited to 3 on the free plan.
The Premium plan adds unlimited quantified habits, personalization options (accent colors, Glass display mode, recap card styles) and access to the AI coach, up to 20 messages per day. Prices:
- 3,99 € per month, with no commitment.
- 38 € per year, i.e. 3,17 € per month, a saving of 20% compared with the monthly price.
Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. Prices may change; a price change is announced at least 30 days in advance and never applies to a period that has already been paid.
Current state of payment
Online payment is not open yet: no payment method is collected and no money is taken at this time. Articles 5 to 8 below will apply as soon as payments open. Existing Premium accounts were granted manually, free of charge.
5. Subscription, renewal and cancellation
The subscription renews automatically at the end of each period, for the same duration, unless you cancel before the end of the current period.
In accordance with article L215-1-1 of the French Consumer Code, you cancel online, from your settings, as easily as you subscribed and without having to contact support. Cancellation takes effect at the end of the period already paid: you keep Premium access until that date, with no renewal afterwards.
For an annual subscription, a reminder that you can choose not to renew is sent to you at the latest one month before the cancellation deadline, in accordance with article L215-1 of the same code.
6. Right of withdrawal
As a consumer, you have 14 days from the date of subscription to withdraw without giving a reason and without penalty, in accordance with article L221-18 of the French Consumer Code.
Because Premium access is activated immediately after payment, you are asked, when subscribing, to expressly consent to this immediate performance. This consent does not make you lose your right of withdrawal: if you exercise it within 14 days, only the amount corresponding to the days actually used may be kept, and the rest is refunded to you.
To withdraw, simply write to contact@eloandsg.com stating your account email address. No particular wording is required.
7. Refund policy
On top of the legal right of withdrawal, the following rules apply:
- Within 14 days of subscribing: refund pro rata for the unused days, with no justification needed.
- Service unavailable for more than 72 consecutive hours because of the publisher: refund pro rata for the duration of the unavailability, on simple request.
- Premium feature removed during a subscription with no equivalent offered: refund pro rata for the remaining period.
- Double charge or billing error: full refund of the amount wrongly charged.
- After 14 days, without reason: the current subscription is not refunded, but you can cancel immediately to prevent any renewal.
Every request is handled within 14 days. The refund is made by the same payment method as the one used to subscribe, unless agreed otherwise.
8. Consumer mediation
In accordance with article L612-1 of the French Consumer Code, if a dispute is not resolved directly with the publisher, you can use a consumer mediator free of charge:
[Mediator to be appointed before payments open: name, address and website to be filled in.]
9. Availability and liability
The publisher undertakes to use reasonable means to keep the service available, without being able to guarantee absolute continuity: interruptions may occur for maintenance or because of a third-party provider. These interruptions entitle you to the refund provided in article 7 when they exceed 72 consecutive hours.
The publisher's liability cannot exceed the sums actually paid by the user over the last twelve months. Nothing in these terms limits the rights the law gives to consumers, in particular the legal guarantee of conformity of digital content and services provided for in articles L224-25-12 and following of the French Consumer Code.
10. Changes to the terms
Any substantial change is notified in the application at least 30 days before it takes effect. If it does not suit you, you can cancel free of charge before that date.
11. Governing law
These terms are governed by French law. In case of a dispute, an amicable solution is sought first, then the mediation provided for in article 8. Failing that, French courts have jurisdiction. If you live in another member state of the European Union, you keep the benefit of the mandatory consumer protection provisions of your country of residence.
